1. General Terms

1.1 About These Terms

All goods and services sold by Yottabyte Limited ("we", "us", "our") are supplied subject to these Terms and Conditions. By placing an order through our website, you ("you", "your", "customer") agree to be bound by these terms.

1.2 Variations

We reserve the right to update these Terms and Conditions at any time. The version in effect at the time you place your order will govern that transaction. We recommend reviewing these terms before each purchase.

1.3 Information Accuracy

While we strive to ensure all product information, prices, and descriptions on our website are accurate, errors may occur. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

2. Order Acceptance and Confirmation

2.1 Binding Contract

When you click "Complete Order" or similar checkout button, you make an offer to purchase. A binding contract is formed only when:

  • We send you an order confirmation email, AND
  • We accept your payment

2.2 Order Refusal Rights

We reserve the right to refuse or cancel any order, even after acceptance, in the following circumstances:

  • Product pricing errors or technical glitches
  • Product unavailability or stock issues
  • Suspected fraudulent transactions
  • Information provided appears incomplete or inaccurate
  • Failure to meet our verification requirements

2.3 Order Cancellation by Customer

You may cancel your order within 24 hours of placement by contacting us immediately at hello@mapleby.com, provided that customization/engraving has not yet begun. Once engraving has commenced, cancellation is not possible. See Section 6 for returns and refunds policy.

3. Customized Products - Important Information

3.1 Nature of Customization

Our products feature personalized engraving including:

  • Custom names and text
  • Choice of fonts (9 styles available)
  • Choice of logos/designs (24 options available)
  • Choice of animal shapes (27 varieties)

IMPORTANT: Because each product is made to order with your specific personalization, different terms apply compared to standard retail products.

3.2 Customer Responsibilities

You are responsible for:

  • Accuracy of Information: All spelling, capitalization, punctuation, and text content you provide
  • Design Choices: Font style, logo selection, and animal shape selection
  • Timely Review: Reviewing and confirming order details within 24 hours of placing your order
  • Legibility: Ensuring text provided is appropriate length for the product size

3.3 Our Production Process

  1. Order Received: Your order is logged in our system
  2. 24-Hour Review Window: You have 24 hours to contact us with any changes
  3. Production Begins: Engraving and customization starts (typically within 24-48 hours)
  4. Quality Check: Each product is inspected before shipping
  5. Dispatch: Product is shipped to your address

3.4 Design Preview and Approval

We do not provide design previews or proofs before production. Please carefully review all customization details in your order confirmation email. If you notice any errors, contact us immediately within 24 hours.

3.5 Modification Time Limits

  • Within 24 hours of order: Free modifications available (contact us immediately)
  • After 24 hours: Modifications not possible if production has begun
  • After dispatch: No modifications possible

4. Pricing and Payment

4.1 Pricing

All prices are displayed in New Zealand Dollars (NZD) and include GST (Goods and Services Tax) as required by New Zealand law.

4.2 Pricing Errors

If a product is listed at an incorrect price due to a technical error or mistake, we reserve the right to:

  • Cancel the order and provide a full refund, OR
  • Contact you to confirm if you wish to proceed at the correct price

This applies even if we have already sent an order confirmation.

4.3 Payment Methods

We accept the following payment methods:

  • Visa
  • Mastercard
  • American Express
  • PayPal
  • Other payment methods as displayed at checkout

4.4 Payment Processing

Payment is processed at the time of order placement. Your order will not enter production until payment is successfully confirmed.

4.5 Additional Charges

You are responsible for any applicable:

  • Import duties (for international orders)
  • Customs fees
  • Local taxes in your jurisdiction
  • Any other government-imposed charges

5. Shipping and Delivery

5.1 Shipping Costs

New Zealand Domestic Shipping:

  • Standard: $5.00 per order
  • Rural delivery: $10.00 per order
  • FREE SHIPPING on all orders over $80.00 NZD

International Shipping: Rates calculated at checkout based on destination and weight.

Note: Free shipping threshold ($80 NZD) is calculated on the subtotal after discount codes are applied, but before shipping fees are added.

5.2 Excluded Locations

We currently do not ship to:

  • Chatham Islands
  • Stewart Island

5.3 Delivery Timeframes

Production Time: 7-10 business days from order confirmation Shipping Time:

  • New Zealand: 3-5 business days
  • Australia: 7-10 business days
  • International: 10-21 business days

Total estimated delivery: 10-15 business days (NZ), 14-20 business days (AU), 17-31 business days (International)

5.4 Delays

We will notify you if we anticipate delays beyond the estimated timeframe. We are not liable for delays caused by:

  • Courier service delays
  • Customs processing
  • Natural disasters or force majeure events
  • Incorrect shipping address provided by customer

5.5 Delivery Address

You must provide a complete and accurate delivery address. We are not responsible for orders delivered to incorrect addresses provided by you. Address changes after dispatch may not be possible.

6. Returns, Refunds, and Exchanges

6.1 14-Day Return Policy for Non-Customized Products

For products without personalization/customization, you may return items within 14 days of delivery if:

  • Item is in original, unused condition
  • All original packaging is intact
  • You have proof of purchase
  • Item is not a sale item

How to Return:

  1. Contact us at hello@mapleby.com within 14 days of receiving your order
  2. Obtain a return authorization number
  3. Return item in original condition with all packaging
  4. Return shipping costs are at your expense

Refund Process: Once we receive and inspect the returned item, we will process your refund within 5-7 business days to your original payment method.

6.2 Customized/Personalized Products - No Returns

IMPORTANT: Products with personalized engraving (names, custom text, specific design choices) are made specifically for you and cannot be returned or exchanged unless they are faulty or we made an error.

No returns or exchanges for:

  • Change of mind
  • Customer-provided spelling errors
  • Customer's choice of incorrect font, logo, or design
  • Natural wood grain variations
  • Minor color variations from screen displays

6.3 Faulty or Defective Products

If your product arrives faulty or defective, we will provide a replacement or full refund. You must:

  • Contact us within 7 days of receiving the product
  • Provide photos showing the defect
  • Provide your order number and proof of purchase

What we consider faulty:

  • Product arrives damaged
  • Engraving is illegible or poorly executed
  • Significant manufacturing defects
  • Product does not match what was ordered (our error)

Not considered faulty:

  • Natural variations in wood grain, color, or texture
  • Minor color differences from website photos
  • Customer's spelling errors in provided text
  • Font/logo appears different than expected (if correct to your selection)

6.4 Our Error - Manufacturing Mistakes

If we make an error in your customization (wrong name spelling, wrong font, wrong design - despite your correct order), we will:

  • Provide a free replacement with expedited production, OR
  • Issue a full refund including original shipping costs

You must:

  • Contact us within 7 days of receiving the item
  • Provide photos of the error
  • Provide your original order confirmation

6.5 Return Shipping Costs

Faulty items or our error: We cover return shipping within New Zealand. For international returns, we will discuss the most cost-effective solution with you.

Change of mind (non-customized items only): You pay return shipping costs.

6.6 Sale Items

All items marked as "sale" or purchased with discount codes are final sale and cannot be returned or exchanged unless faulty.

6.7 Exchanges

Exchanges are only available for non-customized products within the 14-day return window, subject to stock availability. Contact us to arrange an exchange. You will be responsible for return shipping costs.

7. Product Information and Disclaimers

7.1 Natural Wood Variations

Our products are made from natural wood, which means:

  • Each item is unique with variations in grain, color, and texture
  • Natural knots, marks, or color variations are not defects
  • Product may appear slightly different from website photos
  • These variations add to the unique character of each piece

7.2 Color Accuracy

Product colors displayed on our website may vary depending on:

  • Your screen brightness and settings
  • Device type (phone, tablet, computer)
  • Lighting conditions in photos

We strive for accurate representation but cannot guarantee exact color matching.

7.3 Product Photos

Product images are for illustration purposes. Your customized product will feature your specific choices (name, font, logo, animal shape). The actual engraving will match your order specifications, not necessarily the example shown in photos.

7.4 Safety and Compliance

All our products meet New Zealand safety standards for children's products. However:

  • Always supervise young children during use
  • Inspect products regularly for wear or damage
  • Discontinue use if any parts become loose or damaged
  • Products are intended for children 0-3 years under adult supervision

8. Discount Codes and Promotions

8.1 Discount Code Usage

  • Only one discount code per order
  • Discount codes cannot be combined with other offers
  • Discount codes cannot be applied to gift cards
  • Some products may be excluded from discount codes

8.2 Free Shipping Threshold Calculation

The $80 NZD free shipping threshold is calculated as follows:

  1. Product subtotal
  2. MINUS discount codes applied
  3. If total is $80 or more = FREE SHIPPING
  4. Shipping fees do NOT count toward the threshold

Example:

  • Cart total: $85.00
  • 10% discount applied: $76.50
  • Result: Does NOT qualify for free shipping (shipping fees apply)

8.3 Promotional Terms

Specific terms apply to each promotion and will be stated clearly in the promotional material. Promotions cannot be combined unless explicitly stated.

9. Intellectual Property

9.1 Website Content

All content on our website, including but not limited to:

  • Product designs and images
  • Text descriptions
  • Graphics and logos
  • Website layout

...is owned by Yottabyte Limited and protected by New Zealand and international copyright laws.

9.2 Customer Content

By providing custom text or designs for engraving, you confirm that:

  • You own the rights to use the text/design
  • It does not infringe on any third-party intellectual property
  • It does not contain offensive, illegal, or inappropriate content

We reserve the right to refuse orders with inappropriate content.

10. Privacy and Data Protection

10.1 Information Collection

We collect and process your personal information (name, address, email, payment details) to fulfill your order. See our Privacy Policy for full details.

10.2 Marketing Communications

By placing an order, you agree to receive:

  • Order confirmation and shipping updates
  • Customer service communications

You may opt in to receive marketing emails. You can unsubscribe at any time.

11. Limitation of Liability

11.1 Consumer Guarantees Act 1993

If you are purchasing for personal use (not business), your rights under the New Zealand Consumer Guarantees Act 1993 cannot be excluded. These terms do not limit your rights under that Act.

11.2 Business Purchases

If you are purchasing for business purposes, the Consumer Guarantees Act 1993 does not apply, and our liability is limited to:

  • Replacement of the goods, OR
  • Refund of the purchase price

11.3 Liability Limits

To the fullest extent permitted by law:

  • We are not liable for indirect, consequential, or special damages
  • Our total liability is limited to the purchase price of the product
  • We are not liable for delays in delivery beyond our reasonable control

11.4 Specific Exclusions

We are not responsible for:

  • Disappointment if a gift recipient does not like the product
  • Missing special occasions due to shipping delays
  • Products lost or damaged by the courier after dispatch
  • Customs delays for international orders

12. Risk and Title

12.1 Transfer of Ownership

Ownership and risk transfer to you upon delivery to your specified address or collection by you from our premises.

12.2 Uncollected Orders

If you fail to take delivery of goods, risk transfers to you at the time we attempted delivery. Storage fees may apply for uncollected orders beyond 14 days.

13. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Pandemic or health emergencies
  • War, terrorism, or civil unrest
  • Government restrictions or regulations
  • Supplier failures
  • Transportation disruptions

14. Governing Law

These Terms and Conditions are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Yottabyte Limited regarding your purchase.
